In a major legal development, Meta Platforms Inc. is set to face trial following a New Mexico judge's decision to deny all motions for summary judgment submitted by the tech giant. The lawsuit, spearheaded by New Mexico Attorney General Raúl Torrez, accuses Meta of facilitating child sexual exploitation through its popular platforms, Facebook and Instagram. The highly anticipated trial will commence on February 2 at the Judge Steve Herrera Judicial Complex in Santa Fe.

Judge Bryan Biedscheid’s ruling marks a significant hurdle for Meta, which had been attempting to avoid a courtroom showdown. Raúl Torrez expressed his determination in a statement, emphasizing the importance of the upcoming legal battle. "Today is an important step toward justice," Torrez stated, underscoring the lawsuit's claim that Meta's design choices have dangerously exposed children to predators and harmful content.

Allegations of Platform Mismanagement

The origins of the lawsuit date back to December 2023, when it was filed against Meta, its CEO Mark Zuckerberg, and its subsidiaries. According to the complaint, an undercover operation by the New Mexico Department of Justice revealed that the platforms routinely failed to safeguard minors. Investigators set up child decoy accounts and reported that these accounts were served explicit content and targeted by adult users soliciting pornographic material. Additionally, unmoderated groups promoting commercial sex were allegedly recommended to these young users.

“Mr. Zuckerberg and other Meta executives are aware of the serious harm their products can pose to young users, and yet they have failed to make sufficient changes that would prevent the sexual exploitation of children,” said Torrez, highlighting the seriousness of the allegations.

The investigation shed light on the alarming prevalence of child exploitative content on Meta's platforms, reportedly surpassing levels found on adult sites like Pornhub and OnlyFans. These revelations led to the 2024 arrests and guilty pleas of several individuals suspected of online predation.

Impact of Meta's Platform Design

The lawsuit goes beyond the allegations of explicit content, arguing that Meta's platform design choices have cultivated what investigators describe as the largest marketplace for child sexual exploitation and trafficking worldwide. The complaint also points to the addictive nature of these design features, which allegedly harm children's mental health, self-esteem, and physical safety.
