Michigan Lawmakers Push for Stricter Online Content Controls

In a move stirring significant debate, a group of Republican lawmakers in Michigan has introduced the Public Morals Corruption Prevention Act, also known as House Bill 4938. Spearheaded by Representative Josh Shriver with co-sponsors Joseph Pavlov, Matthew Maddock, James DeSana, Joseph Fox, and Jennifer Wertz, the bill aims to prohibit a wide range of online content. Targets include pornography in various forms, AI-generated content, and notably, 'erotic audio content' such as ASMR.

Broad Implications for Online Content Creators

The bill doesn't stop at erotic content. It could also impact content discussing or created by transgender individuals, as it seeks to ban depictions and writings expressing a disconnect between biological sex and gender identity. Mike Stabile from the Free Speech Coalition has expressed strong opposition, warning that the legislation could "completely erase transgender people from online viewing, making them the same as pornographers."

"If this bill passes, erotic audio, sex toy reviews, and ASMR YouTube channels could all be banned in Michigan," noted the foreign media outlet, Mashable.

Potential Legal Repercussions and Exceptions

The stakes are high for violators of this proposed legislation. Individuals or organizations that breach the law could face fines up to $100,000 and 20 years in prison, with increased penalties for more significant violations. Specifically, if over 100 pieces of prohibited content are identified, fines could rise to $125,000 with prison terms extending to 25 years.

There are, however, some exceptions within the bill. Content that qualifies as 'peer-reviewed academic content' or 'scientific or medical research' is exempt. Internet service providers are also required to block tools like VPNs, which could be used to bypass these content restrictions, further tightening the legislative grip on digital freedom.
