In a troubling turn of events from early December, a teenager from Tennessee claimed she was warned by an anonymous Instagram user that explicit deepfake images of her were circulating on a Discord server. One of these images was allegedly crafted from a snapshot taken at her school's homecoming the previous September, while another controversial image, suggesting nudity, stemmed from her yearbook portrait captured last June.

When the teenager, who has since reached adulthood, accessed the Discord server, she reportedly encountered images and videos of at least 18 minor girls, many of whom were her schoolmates. These shocking revelations form the backbone of a 44-page lawsuit filed on a recent Monday in San Jose, California's federal court. The suit, brought forth by three anonymous plaintiffs from Tennessee, targets xAI, Elon Musk's artificial intelligence company, accusing it of enabling such misuse with its Grok chatbot.

Class-Action Suit Targets xAI's Grok

The looming lawsuit, seeking class-action status, accuses xAI of reckless technology design, resulting in significant harm. Despite public outcry, the lawsuit contends xAI opted to limit Grok's features to paid subscribers and third-party companies instead of tackling the underlying issues.

“xAI – and its founder Elon Musk – saw a business opportunity: an opportunity to profit off the sexual predation of real people, including children,” reads a statement extracted from the lawsuit by Rolling Stone.

Efforts to reach xAI for comments were unsuccessful, as reported by Rolling Stone on Monday.

Lawyer Reactions and Grok's Controversial Features

Vanessa Baehr-Jones, representing the plaintiffs, articulated the gravity of the situation in her statement to Rolling Stone: “No one should have to live with the fear that these survivors now carry with them, but I am inspired by their strength and clarity of purpose in bringing this lawsuit on behalf of themselves and other minors in the Class.”

The Grok chatbot's image-editing capability gained traction in late December after Musk introduced a feature allowing X platform users to modify images with a simple click. Although Grok wasn't meant to create fully nude images, users allegedly found ways around the restrictions, resulting in deeply offensive content, as the lawsuit outlines.

Increased Scrutiny and Legal Ramifications

As of January 9, access to Grok's image-generation feature was restricted to paying users, with further technical limitations added by January 14. On January 16, Elon Musk publicly declared his unawareness of any illegal images produced by Grok, asserting that the chatbot should follow legal norms.

Meanwhile, the Center for Countering Digital Hate reviewed a sample of 200,000 images from Grok's output and flagged around 23,000 as child sexual abuse material. These findings have only intensified the scrutiny around xAI and its practices.

Amidst ongoing investigations and legal maneuvers, the plaintiffs – alleging severe emotional distress – demand accountability and reparation through a jury trial, hoping to confront the challenges posed by this AI debacle.
