In a growing wave of legal challenges, Nebraska has become the latest state to take action against Roblox, filing a lawsuit on Wednesday. The state accuses the popular gaming platform of exploitation and misrepresentation in its safety practices for children. This lawsuit adds to a list already filed by at least six other states, each citing concerns over direct interactions between minors and adult predators, along with exposure to sexually explicit and violent content.
Since its inception in 2006, Roblox has transformed into a vast social gaming hub with over 151 million daily users. The platform, which describes itself as the largest dedicated gaming space for users under 13, is now under scrutiny for allegedly allowing unsafe interactions. Nebraska Attorney General Mike Hilgers highlighted in the lawsuit the repeated use of Roblox by sexual predators to allegedly groom, abduct, and assault children.
Matt Kaufman, Roblox’s chief safety officer, has responded to Nebraska’s allegations, asserting that the platform maintains safety as a core principle. "While we share Attorney General Hilgers’ commitment to keeping kids and teens safe online, we are disappointed that he has filed a lawsuit that fundamentally misrepresents how Roblox works," Kaufman stated in an email.
“Roblox is built with safety at its core, and we strengthen our protections every day,” Kaufman wrote.
Roblox has implemented several safety measures, including prohibiting image and video sharing, utilizing rigorous filters for personal information, and enforcing age-based chat settings. Additionally, users must undergo facial age verification to chat, and parental controls have been introduced, allowing parents to block specific games or users.
Beyond Nebraska, states like Louisiana, Kentucky, Texas, Florida, Iowa, and Tennessee have also sued Roblox over similar safety concerns. California's Los Angeles County joined them last month, and over 130 individual lawsuits have been consolidated into multidistrict litigation in California’s Northern District.
These legal battles bring forward harrowing stories of children allegedly groomed on Roblox, some tragically resulting in suicide or assault. Despite Roblox’s chat restrictions, predators allegedly lure children to platforms like Discord for more unfettered communication. Discord, also implicated in some of these lawsuits, has stated its commitment to safety but refrains from commenting on ongoing litigation.
This past February, a pivotal legal victory was achieved when a California court allowed a lawsuit involving a 10-year-old victim to proceed in open court rather than confidential arbitration. This decision could set a precedent affecting the application of arbitration clauses in cases involving minors.
In a significant move, over 800 parents from 48 states have publicly urged Roblox and Discord’s boards to halt efforts to enforce arbitration, advocating for transparency in addressing these critical safety issues. "Secret arbitration only protects corporations, not kids," Pat Huyett, a partner at Anapol Weiss, emphasized. Families are seeking open court hearings to ensure child safety measures are adequately addressed.
