After their year-long romance, the two welcomed their daughter, Scottie Rose, and now face the prospect of legal battles as they re-enter single life. Family law expert Frank Perrone weighed in on the potential courtroom drama, highlighting the complexities of celebrity cases.

Perrone, co-chair of the Matrimonial & Family Law Practice at Tarter Krinsky & Drogin, speculated on Davidson's legal strategy: "I imagine [Pete] will probably go in asking for 50/50 parenting time. That’s generally where you start if you’re the non-custodial parent, whether or not he gets that, is different because you’re dealing with a celebrity case and a high-profile case."

Comedy Routine Backfire?

Davidson's hectic schedule and his recent stand-up antics could complicate matters. While performing in Las Vegas, the comedian made a joke that could raise eyebrows in court, saying, "I haven’t done stand-up in five months because I just had a baby, so it’s a lot of fun. I had a little girl. It’s weird having a little girl. It’s hard to watch porn…in front of her. But, uh, I still did… I powered through."

Despite being a part of his comedic routine, Perrone suggested that such comments might influence the court's view: "That would absolutely be a factor that a court could consider, deviant behavior, things of that nature, 100%." With Davidson often on the road for stand-up and filming, maintaining consistent contact with Scottie could be challenging – a crucial factor in custody cases.

Elsie's Social Media Slip

Elsie Hewitt isn’t out of the woods either. Her public comments on TikTok about handling Scottie's expenses solo might not sit well with a judge. Perrone noted that such posts can be problematic: "I think comments like that on social media – it’s not going to look good for her. It really pisses judges off." Both parents need to tread carefully to avoid missteps that could impact their custody battle.

Financially, the stakes are high. With Davidson’s reported earnings surpassing $3 million annually and Hewitt's income from partnerships, child support could hit around $510,000 a year, or $42,500 monthly. As of now, it remains to be seen whether the exes can resolve their issues outside court. For their sake and Scottie's, keeping things amicable would be wise.
