Pornhub Dismisses Texas Age-Verification Law As Ineffective

The Challenge to Texas Laws

Pornhub is calling on Texas and other states to rethink their approach to age-verification laws, arguing these regulations are easy to dodge and endanger adult users' data. The company is pushing for a shift in responsibility, suggesting that tech giants like Apple, Microsoft, and Google should enforce parental controls by default on their systems, rather than relying on individual websites to verify ages.

The Argument Against Current Laws

Last week, Pornhub reached out to state officials across the U.S., including Texas Governor Greg Abbott and Attorney General Ken Paxton, labeling the current age-verification regulations as "performative, ineffective, and unenforceable." The company claims these laws fail to protect minors effectively and instead expose users to potential privacy threats.

"We are serious about protecting minors, and lawmakers like yourselves must recognize that these laws have failed at that objective," Pornhub stated. "If you truly intend to protect minors online, you must acknowledge the facts and introduce a real solution."

Pornhub believes that site-specific age verification cannot be enforced at scale, making it simple for users to evade. They argue that these laws drive users to riskier and non-compliant sites, increasing data privacy risks.

The Numbers Game

According to Pornhub, a Google search for free adult content in Texas shows that nine of the top ten results bypass age verification. "Search results are constantly replenished with new, non-compliant sites," they noted, highlighting the ease with which new sites enter the market, keeping explicit content widely accessible.

The Bigger Picture

Beyond simply visiting unregulated sites, some users are reportedly turning to virtual private networks (VPNs) to mask their location and circumvent restrictions. Pornhub argues that focusing on tech companies to default-enable parental controls would offer more effective protection for minors.

Background on the Texas Law

In June 2023, Governor Abbott signed House Bill 1181, which aims to block minors from viewing explicit content online by requiring websites to verify their users’ age. The law targets any commercial site where over a third of the content might be deemed inappropriate for minors.

Initially stalled by a federal court in Austin, the law was later reinstated by the 5th Circuit Court of Appeals. Although the Supreme Court backed Texas in a 6-3 ruling last year, Pornhub ceased operations in the state, citing the technical and privacy difficulties in adhering to the law.

The adult entertainment industry, including Pornhub, argues that the law infringes on First Amendment rights, while Texas insists that age verification is necessary to protect minors from explicit content online.
