The parents of a 12-year-old girl have taken legal action against Snap Inc. and the man who raped her, after the two connected through Snapchat. The lawsuit, filed in Missouri state court, accuses the social media giant of negligence for not addressing the app's harmful features or warning parents of potential risks.
The tragic events unfolded after the girl joined Snapchat in 2021 at age 11, unbeknownst to her parents. Despite the app's 13+ age requirement, the lawsuit points out that it is easily circumvented by young users. The lawsuit claims that Snapchat's friend recommendation feature linked the girl to Gabriel Joel Valentin-Rios, a stranger who soon began bombarding her with explicit content. The lawsuit alleges that Snapchat’s design made it difficult for her to avoid these unwanted interactions.
“This assault did not happen in a vacuum – it happened because Snapchat’s product design made it easy for a predator to reach and manipulate an unsuspecting child,” stated Matthew Bergman, founder of the Social Media Victims Law Center.
Valentin-Rios, who misled the girl by posing as a 17-year-old local, used Snapchat's Snap Maps feature to obtain her home address without her knowledge. He groomed the girl over time, manipulated her, and ultimately convinced her to meet him in person, leading to the assault. Valentin-Rios has since pled guilty to statutory rape and is serving an 18-year sentence in Missouri.
The lawsuit further alleges that Snapchat ignored Valentin-Rios's multiple accounts, a violation of their policies, and failed to take action against the known risks posed by such breaches. Snap Inc. has yet to comment on the allegations, while the girl suffers from PTSD, anxiety, and depression as a result of the attack.
This lawsuit is not an isolated incident for Snap Inc. In 2024, New Mexico filed a similar suit against the company, claiming that Snapchat’s features encourage sextortion and unwanted adult contact with minors. The court denied Snap's motion to dismiss, indicating a growing scrutiny over the platform's safety protocols.
Plaintiffs in the current case are seeking unspecified damages and demand that Snap take immediate steps to protect children by altering its platform. The lawsuit highlights a critical need for enhanced safety measures to prevent future tragedies.
