In a landmark decision, Gerard McCarthy, a 64-year-old man from County Westmeath, has been sentenced to six years in prison for the sexual abuse of his niece, Catriona Mahon, which took place over 40 years ago. McCarthy, who hails from Clonlost, Killucan, entered guilty pleas to 24 counts each of rape and indecent assault, committed between 1979 and 1985.
Catriona Mahon, now an adult, bravely waived her right to anonymity to ensure McCarthy's identification in the court proceedings. She shared her harrowing experience, stating that the abuse began when she was just seven years old and continued until she was 13. Mahon vividly described how this ordeal turned her childhood into a "nightmare" and left her feeling different and ashamed throughout her adult life.
“I hand you back the shame. It was never mine to carry all these years, it was yours,” Mahon declared in her victim impact statement, speaking to the emotional burden she has carried.
Judge David Keane, presiding over the case, commended Mahon's strength and courage in coming forward and participating in the legal process. He pointed out that the true shame lies with McCarthy, who exploited the trust of a "young and defenseless child" through persistent and remorseless abuse. Despite McCarthy's early admissions of guilt, which were considered a mitigating factor, Judge Keane highlighted the severity of the breach of trust involved.
Ultimately, McCarthy received a seven-year sentence, with the final 12 months suspended under strict conditions for two years. He is also required to partake in a sexual offender's rehabilitation program and will be subject to a two-year post-release supervision order.
The court proceedings revealed distressing details of the abuse, which occurred while Mahon stayed at her grandparents' home. An investigating officer recounted how Mahon, at the age of seven, was subjected to the first assault, and how the abuse escalated to rape shortly after. McCarthy's cooperation with the investigation, according to his defense, included a letter of apology expressing his shame and remorse.
McCarthy, who has no previous convictions, has faced significant personal consequences as a result of these revelations. His defense cited his history of medical issues and the breakdown of his marriage, as well as his longstanding anticipation of arrest over the past four decades. Despite these personal challenges, the court was clear in its condemnation of his actions.
